3. Application

The agreement relates to the purchase and installation of a home charger for electric cars from the Seller. Physical installation is carried out by the Installer as a subcontractor.

The agreement regulates the delivery of what is described in Appendix 1 as the Basic Package and any Additional Orders and customisations. The terms and rights in this agreement are supplemented by relevant legislation, in particular the Consumer Purchases Act and the Cancellation Act.

4. The agreement.

The Buyer enters into the agreement with the Seller at the conclusion of the Agreement. It is a prerequisite that the Buyer is a consumer within the meaning of the Consumer Purchase Act and over the age of 18.

5. Price and payment.

a. The Basic Package itself is invoiced and paid to the Seller in accordance with the Seller's invoicing procedures. All additional orders are invoiced and paid directly to the Installer. The Buyer can choose either cash payment of the purchase price for the Basic Package or an agreed instalment as stated in the Order Confirmation and any instalment plan.

b. In the event of an agreed instalment, the Buyer will be invoiced interest-free and free of charge according to the agreed instalment plan. The instalment amount will appear on the same invoice as the electricity agreement. The Buyer may terminate the instalment agreement at any time by paying the remaining part of the purchase price.

c. The seller has a sales pledge on the charger until the entire purchase price has been paid.

d. If the Buyer materially defaults on the payment obligation, the Seller may terminate the agreement, claim compensation and interest and/or withhold performance.

6. Credit assessment

After the conclusion of the Agreement, the Seller will carry out a credit assessment of the Buyer. If the result of the credit assessment is not satisfactory, the Seller may cancel the agreement.

7. The seller's obligations

The Seller is responsible for the delivery of the Basic Package itself. Any additional orders agreed between the Customer and the Installer are the responsibility of the Installer.

The time when the Seller shall deliver and carry out the installation at the Customer's premises is either stated in the Order Confirmation or agreed directly between the Buyer and the Installer.

8. The buyer's obligations

The Buyer is obliged to assist so that the Installer and any others involved in the delivery have good access to the installation site and the property's electrical installations. The Buyer is also obliged to provide the information requested by the Seller or Installer both before and during the installation.

If the Buyer does not provide the necessary co-operation, including necessary access to the property, so that delivery is prevented or delayed, the Seller may claim any loss from the Buyer. The same applies if the Buyer has not fulfilled his obligation to provide information and this results in additional work for the Seller or the Installer.

9. Cancellation and right of withdrawal.

a. Cancellation
If the Buyer cancels the order before the agreed time for delivery of the charger and any Additional Orders, the Seller and Installer cannot retain the purchase, but may instead claim compensation for losses resulting from the cancellation as well as any costs incurred by both the Seller and Installer. In addition, the Installer's termination costs are covered by an agreed cancellation fee.

b. Right of cancellation
The Buyer has the right to withdraw from this agreement by notifying the Seller before the expiry of the cancellation period set out in the Cancellation Act. The cancellation period is deemed to have been complied with if notification is sent before the expiry of the period. Notification can be made using a completed cancellation form or by other unambiguous declaration.

For all work resulting from the installation of the EV charger, including additional orders, the cancellation period is 14 days from the conclusion of the Agreement. The Buyer may request the Seller to carry out the installation before the expiry of the cancellation period. If the Buyer nevertheless exercises the right of cancellation, the Seller may charge the Buyer for costs incurred. If the installation is completed, the right of cancellation is considered waived.

The cancellation period for the purchase of the EV charger itself and any additional equipment for it expires 14 days after the Buyer has received physical delivery of the EV charger. During this period, the Buyer has the right to withdraw from its obligations even if installation of the EV charger has begun. If the Buyer exercises the right of cancellation, the Buyer must bear the costs of returning the EV charger and any additional equipment to the Seller. Additional equipment can be returned by post to the address provided by the Seller. The electric car charger itself must be removed by the Seller. The Buyer may not dismantle the EV charger himself. The Buyer must cover all costs associated with dismantling and returning the charger. The Seller may claim reimbursement for any reduction in the value of the charger as a result of the Buyer's inspection and handling of the charger.

If the electric car charger is installed, the Buyer must still pay for the installation even if the right of cancellation applies to the electric car charger. Cables run to the charger are considered part of the installation and will not be removed even if the right of cancellation applies to the charger. The buyer's costs in connection with internet connection are not refundable.

10. Complaints

If there is a defect in the installation or the EV charger itself and this is not due to the Buyer or circumstances on the Buyer's side, the Buyer may invoke remedies for breach of contract. The Buyer must then, within a reasonable time after discovering or should have discovered the defect, notify the Seller that the defect will be invoked.

If there is a defect, the Seller is obliged to remedy the defect. If it turns out that there was no defect in the installation or the electric car charger, the Seller may demand payment for the examination and any repairs carried out.

11. Confidentiality, personal data and communication between the Parties.

The Buyer shall provide the Seller with information about his email address and mobile phone number and accepts that the Seller may use these to notify the customer in connection with the customer relationship.

All personal data collected in connection with the conclusion of the agreement and the customer relationship will be processed in accordance with the current privacy policy of Bilselger/Bilutsalg, which can be found at los.no.
